1. Scope of Application and Conclusion of Contract
1.1 These General Terms and Conditions (AGB) apply to all purchase contracts with private customers and businesses concluded via the online store www.chicandina.com (chic andina, owned by Jimena Zabala de Braga, Bleichstr. 18B, D-86153 Augsburg).
1.2 By confirming the order, the customer accepts these AGB.
1.3 The purchase contract is concluded as soon as chic andina confirms the customer's order by email. If no confirmation is provided within a reasonable time, this is considered as a rejection of the order.
1.4 These AGB also apply to contracts concluded by phone, email, or letter. In the order confirmation, customers will be informed of the availability of the AGB on the website. If a customer disagrees with the AGB, they may exercise their right of withdrawal.
2. Prices and Offers
2.1 All prices are quoted in EUR and include the statutory VAT as well as any processing fees. Shipping costs are shown separately.
2.2 chic andina reserves the right to change prices at any time. The prices valid at the time of the order in the online store apply.
2.3 If chic andina reduces prices before delivery, the reduced prices also apply to orders that have already been placed.
2.4 The presentation of products in the online store is not a legally binding offer, but an invitation to order.
2.5 Conditions for promotions and discounts can be accessed with the corresponding offers.
3. Delivery Conditions
3.1 Deliveries are generally made within 3–5 business days within Germany after payment confirmation, and within up to 10 business days to other EU countries.
3.2 If a longer delivery time is necessary, the customer will be informed in due time. If no information is given, the customer is entitled to withdraw from the contract.
3.3 If an item is out of stock, chic andina will make every effort to restock it as quickly as possible without additional shipping costs.
3.4 If an item is no longer available, chic andina reserves the right not to fulfill the order. Payments already made will be fully refunded.
3.5 Shipping Costs:
- Germany: 4.99 EUR (free shipping for orders over 50.00 EUR).
- EU Countries: 11.99 EUR (free shipping for orders over 120.00 EUR).
4. Right of Withdrawal and Cancellation Right
4.1 Customers can withdraw from the purchase contract within 30 days without providing any reason. The period begins upon receipt of the goods.
4.2 Goods already delivered can be returned at the customer’s expense. chic andina will refund the purchase price for returned items, but not the return shipping costs.
4.3 If a customer withdraws from the contract due to delayed delivery, defects, or other reasons for which chic andina is responsible, chic andina will refund the purchase price as well as the return shipping costs.
4.4 The right of return applies only if the goods were used exclusively for trying on (similar to trying on in a retail store) and are returned complete and undamaged. No refund will be issued for damages caused by the customer.

5. Liability and Warranty
5.1 The buyer is obliged to immediately inspect the goods upon receipt and report any defects in writing to info@chicandina.com within 7 days.
5.2 If a defect is present, the buyer has the following options:
- Repair (free repair or replacement),
- Price reduction (appropriate deduction from the purchase price),
- Contract cancellation with refund of the purchase price.
5.3 chic andina will cover the return shipping costs as well as replacement shipping costs in the case of a legitimate defect.
6. Payment Methods
Payment is possible via credit card, PayPal, Google Pay, Apple Pay, or other locally available payment methods.
7. Liability for Online Connections
7.1 chic andina commits to taking all reasonable technical and organizational measures to ensure the security of the website.
7.2 The customer is responsible for securely storing their access data.
7.3 chic andina is not liable for failures or security deficiencies caused by third-party providers, force majeure, improper use, or interventions by third parties (e.g., virus attacks), as long as all necessary security measures were taken.
8. Governing Law and Jurisdiction
8.1 German and European law applies.
8.2 For claims made by a customer, the court at their place of residence is responsible. For claims made by chic andina against the customer, the customer’s place of residence is also considered the court of jurisdiction.
8.3 For foreign customers, the courts at the location of chic andina may alternatively be competent.
